Overview

Welcome to Merchants of Freedom! The terms "we", "us" and "our" refer to Merchants of Freedom, a business operated by its owners (currently trading as sole traders). Merchants of Freedom operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). Merchants of Freedom is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced here (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights, including your statutory rights as a consumer, and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. Nothing in these Terms affects your statutory rights as a consumer under the laws of England and Wales (or the part of the UK in which you live). If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Section 1 - Access to the Services

By agreeing to these Terms of Service, you represent that you are at least 18 years old, or that you have the consent of a parent or guardian, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including browsing our online store or purchasing any products, you may be asked to provide certain information at checkout, such as your email address, billing, payment and shipping information. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.

Section 2 - Our Products

We make every effort to accurately represent our products, including custom-printed t-shirts and hoodies. However, colour, print placement and product appearance may differ slightly from how they appear on your screen due to your device and its settings, and because each item is printed to order.

All product descriptions are subject to change at any time without notice, at our discretion. We reserve the right to discontinue any product, design or size at any time, and may limit quantities available to any person or region.

This does not affect your statutory right to receive goods that are as described, of satisfactory quality, and fit for purpose under the Consumer Rights Act 2015.

Section 3 - Orders

When you place an order, you are making an offer to purchase. Merchants of Freedom reserves the right to accept or decline your order for any reason. Your order is not accepted until we confirm acceptance, and we must receive and process your payment first. Please review your order carefully, especially size, design and personalisation details, before submitting - because most of our products are printed to order, we may be unable to accommodate changes or cancellations once printing has begun.

If we don't accept, change, or cancel an order, we'll attempt to notify you using the email, billing address, or phone number provided at checkout.

Your right to cancel: Because many of our products are made or personalised to your specification (print-on-demand), the standard 14-day "cooling off" cancellation right under the Consumer Contracts (Information, Cancellation and Charges) Regulations 2013 does not generally apply once production has started. This does not affect your right to a replacement if an item arrives faulty, damaged, or not as described - see our Replacement Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export, unless otherwise agreed with us in writing.

Section 4 - Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect when your order is placed, as shown in your order confirmation email. Posted prices do not include VAT, as we are not currently VAT registered. Posted prices also do not include shipping, handling, or any customs/import charges for international orders unless stated otherwise.

Prices in our online store may differ from prices offered elsewhere, including in any other online or physical stores. Promotions may be governed by separate terms; where these conflict with these Terms, the promotion terms will apply.

You agree to provide current, complete and accurate payment information, and to promptly update it (including your email address and card details) so we can complete your transactions and contact you as needed.

You represent and warrant that: (i) any payment information you provide is true, correct and complete; (ii) you are authorised to use the payment method provided; (iii) charges you incur will be honoured by your card issuer or payment provider; and (iv) you will pay all charges incurred at the posted prices, including shipping and any applicable taxes.

Section 5 - Shipping and Delivery

We aim to dispatch and deliver orders within the timeframes stated at checkout, but all delivery times are estimates and not guaranteed. We are not liable for delays caused by our printing/fulfilment partners, shipping carriers, customs processing, or events outside our reasonable control.

Risk in the products passes to you once they are delivered to you or a person you've nominated to receive them. Legal ownership of the products passes to you once we've received payment in full, including delivery charges.

Section 6 - Intellectual Property

Our Services - including trademarks, brands, text, displays, images, graphics, product designs, reviews, video and audio, and their selection and arrangement - are owned by Merchants of Freedom, its partners, or its licensors, and are protected by UK and international copyright, design right, trade mark and other intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any material from the Services without our prior written consent. Unauthorised use may infringe intellectual property law.

The Merchants of Freedom name, logo, product names, designs and slogans are trademarks of Merchants of Freedom. You must not use them without our prior written permission. Shopify's name, logo and related marks are trademarks of Shopify. All other names, logos and marks on the Services belong to their respective owners.

Section 7 - Third-Party Links

The Services may contain links to third-party websites or content, including embedded functionality. We do not examine or evaluate the accuracy of third-party materials, and accessing them is at your own risk. We are not liable for any harm arising from your use of third-party sites, products or services. Please review the third party's own policies before transacting with them; direct any complaints about third-party products or services to that third party.

Section 8 - Relationship with Shopify

Merchants of Freedom is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Merchants of Freedom. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Merchants of Freedom, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages and liabilities arising from your purchases and transactions with Merchants of Freedom.

Section 9 - Privacy Policy

All personal information we collect through the Services is handled in accordance with UK data protection law (the UK GDPR and Data Protection Act 2018) and our Privacy Policy.

Because the Services are hosted by Shopify, Shopify also processes personal data about your access to and use of the Services on our behalf, in order to provide and improve the Services. Information you submit may be transmitted to and shared with Shopify and other third parties, some of which may be located outside the UK; where this happens, appropriate safeguards are used in line with UK data protection law. Review our Privacy Policy for full details on how we, Shopify, and our partners use your personal information, and your rights over it.

Section 10 - Feedback

If you submit any ideas, suggestions, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback for any purpose, including commercial use, in connection with operating and promoting the Services.

You represent and warrant that: (i) you own or have all rights necessary to submit the Feedback; (ii) you have disclosed any compensation received in connection with it; and (iii) it complies with these Terms. We are under no obligation to keep Feedback confidential, pay for it, or respond to it.

We may, but are not obliged to, monitor, edit or remove Feedback we consider unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that infringes any party's rights or these Terms.

You agree your Feedback will not infringe any third party's rights (including copyright, trade mark or privacy rights), and will not be unlawful, abusive, or contain malware. You may not use a false identity or otherwise mislead us as to the origin of any Feedback. You are solely responsible for your Feedback and its accuracy.

Section 11 - Errors, Inaccuracies and Omissions

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times, or availability. We reserve the right to correct any such errors and to update or cancel orders if information is found to be inaccurate, without prior notice, even after an order has been submitted.

Section 12 - Prohibited Uses

You may access and use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to breach any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame, or harm anyone; (e) to transmit false or misleading information; (f) to send spam or unsolicited promotional material; (g) to impersonate any other person or entity; or (h) to engage in conduct that restricts or inhibits anyone's use of the Services, or which may harm Merchants of Freedom, Shopify, or other users.

You also agree not to: (a) upload viruses or malicious code; (b) reproduce, resell or exploit any part of the Services without permission; (c) collect or track others' personal information; (d) phish, pharm, or pretext the Services; (e) use bots, scrapers, or automated/AI tools to access the Services; or (f) bypass or interfere with any security or access-control measures we use.

We reserve the right to refuse service or block your access to the Services at any time, without notice, if we determine you've breached these Terms.

Section 13 - Termination

We may terminate this agreement or your access to the Services at our discretion, at any time, without notice. You'll remain liable for all amounts due up to the date of termination.

Sections covering Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, and Privacy will survive termination.

Section 14 - Disclaimer of Warranties

Information on the Services is provided for general information purposes only. We don't warrant its accuracy, completeness, or usefulness, and any reliance you place on it is at your own risk.

To the extent permitted by law, the Services and products offered through them are provided "as is" and "as available," without warranties of any kind, except as expressly stated by us or as required by the Consumer Rights Act 2015 and other applicable consumer protection law. Nothing in this section excludes or limits your statutory rights as a consumer, including your rights for goods to be as described, of satisfactory quality, and fit for purpose.

Section 15 - Limitation of Liability

To the fullest extent permitted by law, Merchants of Freedom, its partners, employees, agents, contractors, and service providers (including Shopify and its affiliates) will not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost revenue, or lost data, arising from your use of the Services or any product purchased through them.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability which cannot be excluded or limited under English law, including your statutory rights as a consumer.

Section 16 - Indemnification

You agree to indemnify and hold harmless Merchants of Freedom, Shopify, and our respective partners, employees, agents and service providers from any losses, damages, liabilities or claims (including reasonable legal fees) arising from: (1) your breach of these Terms; (2) your violation of any law or third-party right; or (3) your use of the Services.

We'll notify you of any indemnifiable claim; a delay in notifying you won't relieve your obligations unless it materially prejudices you. We may control the defence and settlement of such a claim at your expense, but won't settle any claim requiring non-monetary obligations from you without your reasonable consent. You agree to cooperate in the defence of any indemnified claim.

Section 17 - Severability

If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable part will be severed, without affecting the validity of the remaining provisions.

Section 18 - Waiver; Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms won't constitute a waiver of that right or provision.

These Terms, together with any policies posted by us, constitute the entire agreement between you and us regarding the Services, superseding any prior agreements or communications, whether oral or written. Any ambiguity in interpretation won't be construed against the drafting party.

Section 19 - Assignment

You may not transfer or assign this agreement or your rights or obligations under it without our prior written consent; any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without notice to you.

Section 20 - Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. You and Merchants of Freedom agree to submit to the exclusive jurisdiction of the courts of England and Wales, save that if you are a consumer resident in Scotland or Northern Ireland, mandatory local consumer protection law may also give you the right to bring proceedings in your local courts.

Section 21 - Headings

Headings in this agreement are for convenience only and do not affect the interpretation of these Terms.

Section 22 - Changes to Terms of Service

You can review the current version of these Terms at any time on this page. We reserve the right to update or change these Terms by posting revisions to our website. We'll notify you of material changes as required by law, and such changes take effect from the date specified in the notice. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
